The regulation does not ask buyers to admire battery passports; it makes three things commercially decisive: a machine-readable data record that must exist before the pack is placed on the market, a named producer responsible for take-back in every Member State where that pack is sold, and a pack an independent professional can physically remove. Where any of the three is missing from the order documents, the failure surfaces late — at listing, at the first swap, or at resale, when the pack has no documented history and therefore no defensible residual value.
The first decision is classification, and it is decided by the pack rather than by the bike. A light means of transport battery is a sealed pack of 25 kg or less designed to provide traction to a wheeled vehicle, and the definition explicitly reaches L-category vehicles. A 25 km/h pedelec longtail therefore sits in the LMT category, and so does an S-Pedelec whose pack stays under the mass threshold; the same platform offered with a larger pack can cross into the EV battery category, with a different carbon footprint timetable and a different passport scope. Swap operations need the same discipline: the cabinet is not a battery, but every spare pack placed on the market is a separate unit with its own identifier, so buying spare packs in bulk means buying a batch of individually registered products.
The compliance calendar is fixed and can be reverse-engineered into a sourcing plan. Producer registration and due diligence obligations became applicable in August 2025, alongside the repeal of the previous battery directive; removability by independent professionals, the QR data carrier and the battery passport itself apply from 18 February 2027; the carbon footprint declaration for LMT batteries follows in February 2028; recycled content documentation from August 2031; recycling efficiency targets bite at the end of 2025 and again at the end of 2030. Working backwards from a port arrival date, a data model that is not frozen before tooling release and BMS firmware freeze cannot be retrofitted into a shipping product. Certification files are only partly reusable: an EN 15194 test report and a UN38.3 test summary support market access and transport but do not populate passport fields, and carbon footprint and recycled content evidence has to be built up the supply chain from cell level.

Treat the passport data model as a hardware-adjacent decision: once firmware and housing are locked, the data fields are locked with them.

The record itself is broader than a serial number. Expect unique identifier, manufacturer and production location, battery category, chemistry, capacity and mass, carbon footprint, recycled content shares, state of health and expected lifetime data, dismantling information, and safety notes. Responsibility is layered. The cell supplier owns chemistry, cell-level carbon footprint and recycled content evidence; the BMS supplier owns the state of health logic and the data dictionary that makes those values readable; the pack assembler owns integration and the declaration that the pack conforms. The brand placing the finished bike or spare pack on the market answers for the record, which is why data obligations have to be pushed upstream in writing rather than collected after mass production.
The carrier is a QR code, with NFC a useful addition rather than a substitute, and the record behind it must survive the pack leaving the bike. In a swap fleet the pack is the long-lived asset and the vehicle is interchangeable, so the identifier belongs on the pack housing in a position that stays readable when the pack is racked, stored or returned, not under a frame cover that only exists on the original bike. State of health values also need a route out of the BMS that does not depend on the vehicle being powered: a depot reader, a service tool, or a telematics module that writes back to the record. In the purchase order and technical agreement, specify the delivery format, the update frequency, the interface documentation and the consequence of late or missing data.
Removability is the clause that quietly rewrites the BOM. From February 2027 LMT packs must be removable and replaceable by independent professionals, which pulls the lock core, housing tolerances, connector type and cable routing into the compliance scope rather than the styling scope. A potted, non-removable pack can look cheaper at quotation stage and becomes expensive at three later points: repair turnaround when a single cell group fails, swap compatibility when a fleet wants to standardise, and dismantling labour at end of life. Second life raises the same question in another form — a retired pack repurposed as depot storage or a spare needs a state of health threshold both parties accept, an entity that certifies it, and a documented transfer of responsibility, otherwise the original producer carries a liability it no longer controls.
Producer responsibility is where geography becomes money. Registration is per Member State, the producer is the entity placing the pack on the market, and for a brand outside the EU that means an authorised representative; a fleet customer redistributing packs across borders adds reporting obligations that are easy to overlook in a single-country contract. Model the cost per pack per year and per kWh for registration, collection, take-back and reporting administration, then add it to the total cost of ownership next to swap logistics and charging. The same logic explains residual value: a pack with no passport record and no readable state of health history cannot be priced by a second buyer, so the compliance gap shows up as a write-down rather than as a fine.
Supplier screening should test capability, not intent. Ask whether the supplier can generate and host passport records or works through a passport service provider, for registration numbers in each target market, for the evidence chain behind recycled content claims, for named recycling partners, for the carbon footprint methodology and system boundary, and for the BMS data dictionary in machine-readable form. Then write the answers into the contract: a notification duty when the regulation or its delegated acts change, document delivery deadlines tied to production milestones, liability for recall or delisting caused by non-compliant documentation, data ownership and transfer on termination, and audit rights at cell and pack level.
Internally, name one owner for compliance and one for data, then run three phases. Now: classify every SKU by battery category, freeze the data model, and attach passport and EPR annexes to every new purchase order. Transition: pilot audit at the pack supplier, register in each market, decide the carrier position on the housing, and equip depots to read state of health. Passport live: connect to the registry, keep the record updated through swaps and repairs, and define how a record transfers with a repacked or resold pack. Because serialised packs make warranty claims evidence-based, negotiate spare pack supply and warranty terms in the same conversation — spare packs are separate products placed on the market and need their own records, and a supplier who cannot deliver that will not be able to support a fleet after 2027.

","EU Battery Regulation: E-Bike Battery Passport & EPR","How
